Please read these Terms carefully before using Vokado. By downloading, installing, or using the app you agree to be bound by these Terms. If you do not agree, do not use the app.

1. About Vokado

Vokado ("the App", "we", "us", "our") is a language-learning flashcard application developed and operated by Ömer Ecer, an individual developer trading as Zibilyon Code, established in Poland (EU) ("Developer"). The App is available on iOS and Android and allows users to create decks, review vocabulary, and track learning progress.

2. Eligibility

You must be at least 13 years old (or the minimum digital-consent age in your jurisdiction) to use Vokado. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Vokado is not distributed in the United Kingdom app stores. The App is not intended for, and is not made available to, residents of the United Kingdom.

We do not knowingly collect personal data from children under 13. If you believe a child under 13 has provided us with personal data, contact us immediately.

3. Account Registration

You may use Vokado as a guest or register an account via Google Sign-In, Apple Sign-In, or email/password. When using Apple Sign-In, Apple may provide a private relay email address instead of your real email. You are responsible for:

Keeping your credentials confidential.
All activity that occurs under your account.
Notifying us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Vokado on devices you own or control, solely for personal, non-commercial learning purposes.

You may not:

Reverse-engineer, decompile, or disassemble the App.
Copy, modify, or distribute any part of the App without prior written consent.
Use the App to develop a competing product or service.
Circumvent any access control or usage limitation features.
Use automated tools, bots, or scrapers to interact with the App.

5. Subscriptions and In-App Purchases

5.1 Free Tier

Vokado offers a free tier with limited features, including a daily cap on AI-powered translations and access to rewarded advertisements to unlock additional usage.

5.2 Premium Subscription

Premium subscriptions are processed through Apple App Store (iOS) or Google Play Store (Android) via RevenueCat. Subscription terms (price, billing period, trial) are displayed at the point of purchase.

Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
Cancellation: Manage or cancel subscriptions via your App Store / Google Play account settings. Cancellation stops future charges; no partial refunds are issued for the current period except where required by law.
Price changes: We will notify you before any price change. Continued use constitutes acceptance.
Refunds: Refund requests are handled by Apple or Google according to their policies.

6. Advertising

The free tier of Vokado displays advertisements served by Google AdMob. By using the free tier you acknowledge that ads may be personalised based on your interests and device identifiers, subject to your consent choices (see Section 10 and our Privacy Policy).

You may opt out of personalised advertising at any time via the app's consent settings or your device's ad-preferences settings.

7. User Content

You may create flashcard decks and import vocabulary ("User Content"). You retain ownership of your User Content. By submitting User Content you grant us a limited license to store, process, and display it solely to provide the Service to you.

You represent that your User Content does not infringe third-party rights, violate any law, or contain malicious code. We may remove User Content that violates these Terms without notice.

8. Third-Party Services

Vokado integrates with the following third-party services. Their use is subject to their own terms and privacy policies:

Google Firebase – authentication, cloud database, push notifications, analytics (firebase.google.com/terms)
Google AdMob – advertising (policies.google.com/technologies/ads)
Google Gemini API – AI-powered translation
RevenueCat – subscription management (revenuecat.com/terms)

We are not responsible for the acts or omissions of these third parties.

9. Intellectual Property

All content in the App that is not User Content — including the Vokado name, logo, design, source code, and built-in learning materials — is owned by or licensed to Zibilyon Code and protected by copyright, trademark, and other intellectual-property laws. Nothing in these Terms transfers any IP rights to you.

10. Privacy and Data Protection

Your use of Vokado is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data, including our obligations under:

11. Consent to Advertising (EEA and Switzerland)

If you are located in the European Economic Area (EEA) or Switzerland, we collect your consent before displaying personalised advertisements, in compliance with the IAB Europe Transparency and Consent Framework (TCF) and applicable data-protection law. You can:

Grant or withhold consent when the consent dialog is first shown.
Change your consent choices at any time via Settings → Privacy & Legal → Manage Ad Preferences in the App.
If you do not consent to personalised ads, you will still see ads but they will not be personalised.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or that translations produced by AI will be accurate.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZIBILYON CODE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF VOKADO.

Our total aggregate liability to you for all claims shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) USD 10.

Some jurisdictions do not allow certain exclusions or limitations, so the above may not apply to you in full.

14. Indemnification

You agree to indemnify and hold harmless Zibilyon Code and its affiliates, officers, and agents from any claims, liabilities, damages, and costs (including reasonable legal fees) arising from (a) your use of the App, (b) your User Content, or (c) your violation of these Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Poland (European Union) (where the Developer is based), without regard to conflict-of-law principles. For users in the EEA, the mandatory consumer-protection laws of your country of residence also apply and prevail over any conflicting provisions here.

If you have a dispute with us, please contact us first at info@zibilyoncode.com. If we cannot resolve it informally, disputes may be submitted to the competent courts of the Developer's jurisdiction, unless your local law requires otherwise.

EU users: You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.

16. Termination

We may suspend or terminate your access to the App at any time if you breach these Terms. You may stop using the App and delete it at any time. On termination, Sections 9 (IP), 12 (Disclaimers), 13 (Liability), 14 (Indemnification), and 15 (Governing Law) survive.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via an in-app notice or push notification at least 30 days before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree to the updated Terms, you must stop using the App.
